1.1. Complete agreement and privacy
The cdlabs Privacy Policy forms part of these terms and conditions, and together they contain all of the terms relating to the use of our websites.

We reserve the right to change these terms and conditions from time to time, and the amended terms will be posted on our websites.

3.1. 4. Our liability
4.1. Users of this website are responsible for any decisions they take based on information provided on the site. We do not accept liability (as far as permitted) for any loss arising from using or relying on information or links included in this site.
Arrangements made between you and any third party named or referred to on the website are entirely at your sole risk and responsibility.
4.2. You agree to indemnify and hold us harmless from any liability, loss, claim, and expense (including reasonable legal fees) related to any breach by you of these terms and conditions or arising from your use of our website.
4.3. cdlabs shall not be liable for any loss of profits, loss of contracts, loss or corruption of data, or other economic loss arising in connection with this Agreement.
4.4. Our websites may contain links to other sites, which are outside our control and are not covered by these terms and conditions.
If you access other sites using the links provided, we cannot be responsible for the content of those sites or for the way in which they deal with you or use any information they may acquire about you.
4.5. cdlabs tries to meet AAA standards of accessibility, but cannot guarantee that this website will be compatible with all hardware and software that may be used by visitors to the site.
4.6. No advice or information, whether oral or written, obtained by you from cdlabs or through or from the service shall create any warranty not expressly stated in this agreement.
4.7. You agree that cdlabs services are used to transform your own materials into a digital format. You agree that any media submitted to cdlabs contains materials in which you own the relevant copyrights or non-copyrighted materials. It is your responsibility, not cdlabs, to ensure that any material that you convert using cdlabs does not violate anyone's copyright. You agree to defend and hold cdlabs harmless from your violation of copyright laws by your use of the service. If you are uncertain about your right to copy, convert or permit access to any material, you should contact your legal advisor.

5. Disclaimer
5.1. cdlabs makes no warranty that (i) the digital music library products will meet your requirements; (ii) the digital music library products will be compatible with any particular music-listening device; or (iii) it will successfully copy all of your chosen CD(s) onto a digital music library product (iv) the artwork, meta tags and file names applied to the digital music library products are provided on a best endeavours basis. CDlabs give no guarantees it will be entirely accurate nor consistent. CDs with defects that are submitted to cdlabs may not be converted if they do not result in a perfect encoding, these CDs will still count towards the number of CDs encoded.
5.2. No advice or information, whether oral or written, obtained by you from cdlabs or through or from the service shall create any warranty not expressly stated in this agreement.

6. Your liability
You shall compensate us in full if we incur any losses or if any claims or legal proceedings are brought or threatened against us by any other person arising from your use of our website.

7. Acceptance of these terms
This Agreement is deemed to be made in England and is subject to English law and the exclusive jurisdiction of the English courts.

8. Matters beyond reasonable control
Neither party is liable for any breach of this Agreement that is caused by a matter beyond its reasonable control, including acts of God, fire, lightning, explosion, war, flood, industrial disputes, sabotage, extremely severe weather, or acts of local or central Government or other competent authorities.

9. Your personal information
We will collect personal information in connection with the service we provide. The cdlabs Privacy Policy has details on what information we collect, what we do with that information, and other related matters such as cookies.

10. Ordering
10.1. All orders are subject to our acceptance. By submitting your order you are offering to buy the service at the price set out in the order and allowing us to use your personal details to supply the products.
We may not necessarily keep a copy of your order. We advise you print a copy of them for your information in the future.
10.2. We are not obliged to supply the service you have ordered until we have confirmed that we have accepted your order. No contract will exist until we have accepted your order.
10.3. All prices include VAT where payable at the current rates. You can pay by credit or charge card. We accept, MasterCard, Visa, and Switch/Maestro.
10.4. We aim to commence processing of your order within 48 hours.
10.5. Goods will be sent by courier but may take longer to arrive at UK offshore islands and the Scottish highlands. cdlabs is not liable for courier delivery schedule variations.
10.6. All credit- and charge-card holders are subject to validation checks and authorisation by the card issuer.
If the issuer of your payment card refuses to authorise payment to us, we will not confirm acceptance of the order, no contract will be formed, and we will not be liable for any delay or non-delivery. You do not own the goods until we receive payment in full.
Clause covering fraudulent use of credit card
10.7 At our option, we will either refund or credit the charges you paid for the services (including shipping charges, if applicable) upon your request if we fail to properly provide the services or to properly ship the products, subject to limitations described above. In order to qualify for a refund or credit due to service failure, the following limitations apply: To obtain a refund or credit, at our option, for a service failure, You must notify us within fifteen (15) days of the earlier of (i) the date of invoice or (ii) the date of shipment or the date picked up.
10.8 You agree that your failure to provide an accurate shipping address or any other other pertinent information shall void your order and any refund is solely at cdlabs's discretion. You agree that cdlabs's inability to provide a copy of the delivery record or a copy of the signature obtained at delivery shall not yield cdlabs's liable to any amount exceeding any reimbursements cdlabs's receives from the delivery service provider less cdlabs's incurred expenses.
10.9 In the case of a claim concerning any non-delivery, misdelivery, late delivery, damaged shipment or other shipping-related claim, you must retain all original shipping containers, packaging and contents and make the foregoing items available for our inspection. The right to damages against cdlabs under any cause of action arising from or related to the provision of Services or Products or shipment of any Products shall be null and void unless an action is brought within 90 days of the date of order.
10.10 In the case of the courier being unable to make the requested collection e.g. non-attendance at collection address there will be a further re-collection charge to be paid for by the customer and charged at the couriers standard rate for any subsequent collection dates.

11. Cancellation policy
11.1. After your contract has been accepted by us you have the right to cancel the order up to and until you ship your CD's to us for encoding. You will however be liable for any incurred costs up to the time of cancellation.
To cancel the contract you need to send a written cancellation request by post to cdlabs or contact us.
11.2. You should arrange for the goods to be returned to the above address and we shall arrange for a full refund (excluding return postage) within a maximum period of 30 days from notice of cancellation.
If we do not receive the goods back from you we may arrange for the item(s) to be collected from you within 14 days of your notice of cancellation and charge the cost of collection to you.
11.3. Please note that your statutory rights are not affected. However, if you do choose to cancel, we would remind you that there is a legal requirement for you to take good care of the goods until you have returned them to us.
